1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the Light Up 7 website and services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

Light Up 7 operates from Sydney, Australia, and these Terms are governed by the laws of New South Wales, Australia.

2. Services

Light Up 7 provides creative production services to agencies, including but not limited to:

  • Motion & Animation (explainer videos, social content, campaign assets, motion graphics)
  • 3D Visualisation (exhibition stands, product renders, architectural visualisations, environments)
  • Immersive Experiences (augmented reality, virtual reality, WebAR, interactive installations)

All services are delivered according to the package or custom scope agreed upon between Light Up 7 and the client prior to project commencement.

3. Engagement and quotes

All project engagements begin with a written quote or proposal issued by Light Up 7. A project is considered confirmed once the client provides written acceptance of the quote (including via email) and any required deposit has been received.

Quotes are valid for 30 days from the date of issue unless otherwise stated. Pricing is quoted in Australian Dollars (AUD) and is exclusive of GST unless stated otherwise.

4. Payment terms

  • A 50% deposit is required before work commences unless otherwise agreed in writing
  • The remaining balance is due upon project completion and delivery of final files
  • For retainer arrangements, payment terms will be outlined in the retainer agreement
  • Invoices are payable within 14 days of issue
  • Late payments may incur interest at the rate of 2% per month on outstanding amounts
  • Light Up 7 reserves the right to suspend work on any project with overdue payments

5. Revisions and feedback

Unless otherwise stated in the project scope, all packages include up to three (3) rounds of revisions. Each revision round requires one consolidated feedback document from the client.

  • Feedback must be provided within 5 business days of each deliverable, unless otherwise agreed
  • Additional revision rounds beyond the included three will be quoted separately
  • Changes to the original scope or brief after production has commenced may incur additional charges
  • If feedback is not received within 10 business days, the project may be considered approved and final

6. Turnaround and delivery

Turnaround times are estimated from the date the project is confirmed (written approval and deposit received) and all required materials, assets, and brief information have been provided by the client.

  • Delays in providing feedback, assets, or approvals may extend the project timeline
  • Rush turnaround options are available on select packages and will be quoted accordingly
  • Light Up 7 will make reasonable efforts to meet agreed deadlines but does not guarantee delivery dates where delays are caused by circumstances beyond our control

7. Intellectual property

Upon full payment of all outstanding invoices:

  • The client receives full ownership of the final deliverables as specified in the project scope
  • Light Up 7 retains the right to use project work in its portfolio, website, social media, and marketing materials unless a non-disclosure or confidentiality agreement is in place
  • Any pre-existing intellectual property, templates, tools, or proprietary processes used by Light Up 7 remain the property of Light Up 7
  • Third-party assets (stock footage, music, fonts, plugins) are subject to their respective licence terms and the client is responsible for ensuring appropriate licences are maintained

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This includes but is not limited to project briefs, creative concepts, business strategies, pricing, and client data. Confidentiality obligations survive the termination of the engagement unless the information becomes publicly available through no fault of the receiving party.

9. Cancellation and refunds

  • If a project is cancelled by the client before work has commenced, any deposit paid will be refunded in full
  • If a project is cancelled after work has commenced, the client will be invoiced for all work completed to date, and any remaining deposit will be applied against this amount
  • Light Up 7 reserves the right to cancel a project if the client fails to provide required materials, feedback, or payment within reasonable timeframes, after providing written notice
  • No refund will be issued for completed and delivered work

10. Limitation of liability

To the maximum extent permitted by law, including the Australian Consumer Law:

  • Light Up 7's total liability arising from or related to the services is limited to the total fees paid by the client for the specific project in question
  • Light Up 7 is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities
  • Light Up 7 does not warrant that the deliverables will achieve any particular commercial result for the client

Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded or limited by law.

11. White-label and subcontracting

Light Up 7 operates as a white-label production partner for agencies. We understand the importance of discretion and will not contact your end clients directly unless expressly authorised. Light Up 7 may engage trusted subcontractors or team members to deliver parts of a project, and remains responsible for the quality and timeliness of all work delivered.

12. Website use

By using the Light Up 7 website, you agree not to:

  • Use the website for any unlawful purpose
  • Reproduce, duplicate, copy, or exploit any part of the website content without express written permission
  • Attempt to gain unauthorised access to any part of the website or its systems
  • Use automated tools to scrape, crawl, or extract data from the website

13. Dispute resolution

In the event of a dispute arising from these Terms or any project engagement, both parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may refer the matter to mediation administered by the Australian Disputes Centre (ADC) in Sydney. The costs of mediation will be shared equally. If mediation is unsuccessful, either party may pursue legal remedies in the courts of New South Wales, Australia.

14. Changes to these terms

Light Up 7 reserves the right to update these Terms at any time. Changes will be posted on this page with a revised "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
